Legal information
Liability
Craftaufwand is liable for damages in accordance with the statutory provisions – without limitation if a breach of duty attributable to Craftaufwand is based on intent or gross negligence. Where a breach of duty attributable to Craftaufwand is based on simple negligence and an essential contractual obligation has been culpably breached, liability for damages is limited to the foreseeable damage typically occurring in comparable cases. Essential contractual obligations are the respective main contractual performance obligations as well as other contractual (secondary) obligations whose culpable breach may endanger the achievement of the purpose of the contract. In all other respects, liability is excluded. However, the full liability of Craftaufwand under the provisions of the Product Liability Act remains unaffected. Liability for injury to life, body and health also remains unaffected. The full liability of Craftaufwand furthermore remains in place in the event of the assumption of any guarantees or fraudulent misrepresentation by Craftaufwand.
